Punto y Línea 07, S.L. carries out, under the trade name of Blipoint, the development of an Internet portal whose functionality is based on the management put at the disposal of the users of photographic images and illustrations, creating with this purpose a file of photographic and illustrative artists in the network.
Every user has access, under the conditions given, to Blipoint files in order to upload his/her photos and illustrations.
Conditions of use
To register, the user will need to complete his/her personal data under “Register Sheet” on the Blipoint portal.
Once the “Register Sheet” is completed, the user will obtain a password to have access to the portal, and to be able to load his or her photos or illustrations in Blipoint files.
The photos or illustrations can be loaded in different sections of the web page; every section corresponds to a different category.
You agree to be the only person responsible (Blipoint will not assume responsibility for you or third parties) for the contents that you load in the Blipoint files, as well as for the consequences resulting from your actions (including any loss or damage that Blipoint could incur).
Every user will have access to all categories without limitation. In case that the administration of Blipoint considers that the photos or illustrations loaded do not correspond to the category assigned by the user, it will arrange them in the section and category that it considers to be more suitable.
User’s content
Users continue being owners of the photos and illustrations that have been loaded on the site.
Limitations on the use
You agree not to use the site or any product or service available on it for any illegal intention or use prohibited by the terms and conditions. You promise not to publish or load any material that:
a) Violates the copyright, the commercial secret or other rights of property of others;
b) Violates the rights of privacy or advertising, or other personal rights of others;
c) May be obscene, slanderous, threatening, harassing, improper, odious or awkward for others;
d) Usurps the identity of another person.
In addition, you agree not to provide user’s content with material that contains viruses, Trojans, worms, etc. destined to damage, disable (even if temporarily) or harm in any form the accessibility, management or access to the Blipoint’s web portal and of the available links on the site.
You agree not to take part in any activity that impedes or interferes with the functioning of the services (or of the servers and networks that are connected with them).
You accept that all information of identification provided to the site (including, but not limited to, your name and email address) will be accurate, complete and exact.
Blipoint has the right, but not the obligation, to control, edit or eliminate any content on the site that, to its exclusive criterion, it considers to be unacceptable, undesirable, inappropriate or that violates these terms and conditions.
Exclusion of guarantee
The site, its contents and the products and services available are provided as is, and according to availability without representation or guarantee of any type.
Disclaimer
Under no circumstances will Blipoint or its respective managers, directors, personnel, agents, representatives, suppliers or content suppliers or service be responsible for damages of any type, including without limitation the direct, indirect, compensatory, special, incidental, punitive and consecutive losses, even in cases where they were informed about the possibility of such damages, that it should be in an action under contract, negligence or another theory, proving of or with regard to the use, disability of use or execution of the site or any material, product or service available on the site.
You admit and accept that Blipoint will be able to interrupt permanently or temporarily the presentation of the services (or any of their characteristics) that are offered to you or to users in general, to exclusive choice of Blipoint, without obligation of notice.
Links to third parties and frames
Blipoint can provide links to web sites with ownership of third parties in which it does not exercise any representation. Blipoint is not responsible for the practices of privacy, content or functioning of such websites.
Blipoint reserves the right to deactivate any non-authorized image and specifically it excludes any responsibility for the contents of any other websites linked to the site. You cannot use the site or any available service on the site with relation to any other website.
Communications with Blipoint
You accept that no commentary or other information provided by you to Blipoint will violate any personal right or right of property of any third party (including, without limitation, the copyright and rights of brand). You accept that no commentary or other information provided by you to Blipoint will be slanderous, obscene, harassing, improper or illegal and that you remain as the only one responsible for the contents of any commentary or other information provided by you to Blipoint.
Policy of Privacy
Please, read the “Politics of Privacy” of Blipoint for information about practices of privacy of Blipoint with regard to the site.
Indemnity
You agree to indemnify and to exempt Blipoint from responsibility, and its respective managers, directors, personnel, agents, representatives, suppliers and suppliers of content and service of and against losses, expenses, damages and costs, including reasonable honorarium of attorney, resultant of any violation of these terms and conditions or any activity related to your Blipoint account (including negligent or illicit conduct) for you or any other person who accedes to the site using your Internet account, Blipoint username on the site or password account.
Changes in the conditions
Blipoint will be able to introduce at any time changes in the conditions of the present contract. When such changes occur, Blipoint will include a new copy of the conditions in the section “Conditions User Contract”.
You recognize and accept that if you use the services of Blipoint after the date in which conditions have changed, Blipoint will hold you accountable for the updated version of conditions.
You accept that Blipoint will be able to send notifications, including the information relative to change conditions, by means of e-mail, postcard or posting the notifications on the web portal of Blipoint.
Changes in the site and ending
Blipoint reserves the right to change or interrupt temporarily or permanently the site, and the products and services available on it, including, but not limited to, modification or elimination of functions or other information without previous notice. You accept that Blipoint is not responsible for any modification, suspension, interruption or suppression of the site, any element that composes the site or any product or service available on it (including but not limited to suppression of any user’s content).
Blipoint reserves the right, to its exclusive criterion and without previous notice, to suspend or terminate your account, or your right to access the site, the products and available services on it, for any motive at any time.
Notice of violation
If you believe that your work has been copied and it is accessible on the site in a way that constitutes a violation of the copyright, please provide the following information in writing to Blipoint:
1. An electronic or physical signature of the person authorised to act in name of the owner of interest linked with the copyright;
2. A description of the work protected by copyright of which rights, according to you, have been violated;
3. A description of where on the site one finds the material that, according to you, constitutes the violation;
4. Your address, telephone number and email address;
5. A statement explaining that you have in good faith the belief that the disputed use is not authorized by the owner of the copyright, its agent or the law; and
6. A declaration, done under the threat of perjury, that the information above is exact and that you are the owner of the copyright or you are authorized to operate in name of the person who indeed is.

Applicable law
The use of the site is governed by Spanish laws without taking into consideration its choice of legal principles.
Any reason of action or demand that you may have with regard to the site of Blipoint (including without limitation your purchase of products of Blipoint) must be initiated within (1) year after the reason of action or demand appears.
Nothing that is stipulated in the conditions will affect the legitimate rights that correspond to you at all times as a consumer that cannot be contractually modified or which cannot be waived.
If a competent Court determines that any provision of the present conditions is invalid, the above mentioned provision will be eliminated from the conditions without affecting the rest. The remaining provisions of the present contract will remain valid in all terms.
Protection of Personal Data
The information provided by the user is subject to provisions of the Law 15/1999 of 13 December, of protection of personal data. To these effects, the user remains informed and authorizes Blipoint to computerized processing of personal data, being able to exercise the rights of access, rectification, cancellation and opposition on the same ones.
You agree to receive, to the e-mail address that you indicated in the “Register of the User,” advertising promotions from Blipoint. In the ocassion that you do not want to receive any type of advertising, send an e-mail to the following address legal@blipoint.com, expressing your desire not to receive advertising communications from Blipoint.
You can exercise at any time your rights of opposition, access, as well as rights of rectification and cancellation, by means of communication by e-mail to the following email address legal@blipoint.com
